HCMC Think Tank Proposes Replacing Building Permits with Construction Registration
On May 30, the Institute of Economic, Natural Resources and Environmental Studies submitted a proposal to Ho Chi Minh City leaders, recommending the replacement of building permit procedures with a construction registration system.
Under the proposal, residents would register construction activities based on alley boundaries and architectural guidelines set out in the city's urban design regulations. Standardized registration forms would be issued by local ward or commune authorities to simplify procedures while ensuring adequate information for project supervision and completion.
The Institute argues that the current Construction Law allows exemptions from building permits for housing projects within areas covered by detailed 1/500 zoning plans. Therefore, a registration-based approach could legally be implemented in HCMC.
Dr. Pham Viet Thuan, Director of the Institute, stated that eliminating permits would ease the process for residents and align with the Prime Minister’s administrative reform efforts, without compromising state oversight or urban planning control. Violations of registered construction details would still be subject to penalties under existing regulations.
The Institute also proposed allowing an additional floor for individual houses with a frontage wider than 5.5 meters and a depth of 12 meters or more, to improve land-use efficiency in areas with upgraded infrastructure.
The proposal follows Prime Minister Pham Minh Chinh’s recent directive, issued on May 29, which tasked the Ministry of Construction with reducing permit-related procedures by at least 30% in both time and administrative costs. He also ordered streamlined processes for projects with approved 1/500 master plans or located in designated urban design zones.
Vietnam's 2014 Construction Law stipulates a 15-day permit processing time for private homes and 20 working days for other projects, with procedures involving four key steps.
